The DOJ just announced that physical therapist, Nelly Anderson, was convicted by a Florida jury for conspiracy to defraud the United States and pay health care kickbacks and two counts of paying kickbacks in connection with a federal health care program.
Anderson was the owner of Dial 4 Care, a company providing home health care services to Medicare beneficiaries. Anderson hired and paid kickbacks to various marketers in exchange for patient referrals in violation of the Anti-Kickback Statute (AKS), according to evidence presented at trial. The AKS prohibits the exchange of remuneration to induce patient referrals or services payable by federal health care programs. As a result of the foregoing scheme, Anderson submitted claims to Medicare that were the result of illegal kickbacks.
Anderson now faces up to 25 years in prison—5 years for the conspiracy count and 10 years for each kickback count. This matter comes as a result of the Health Care Fraud Strike Force Program, which has charged over 5,000 defendants since its inception in March 2007. Anderson is scheduled for sentencing on December 5, 2023.
