The DOJ announced that Vladislav Kotlya was sentenced to two years and nine months in prison for mail fraud. Kotlya previously pleaded guilty to mail fraud related to his $1.9 million baby formula scheme, a portion of which took place during the national baby formula shortage.
According to the Government, Kotlya defrauded health insurers by submitting fraudulent claims for baby formula. Kotlya obtained prescriptions and medical records for expensive specialty baby formula and forged the records to receive larger quantities. Upon receipt of the specialty baby formula, Kotlya concocted stories about incorrect and damaged shipments, even impersonating the infants’ fathers, to receive additional replacement formula at no cost. In turn, Kotyla sold0 the fraudulently obtained specialty baby formula. Kotyla ultimately caused the submission of $1.9 million in false claims to health insurers.
In addition to 33 months in prison, Kotlya agreed to forfeit $1 million and pay approximately $738,000 in restitution.
