Atlanta U.S. Attorney’s Office Announces $14 Million False Claims Act Settlement with Local Physician Group

On April 2, 2026, the United Attorney’s Office in Atlanta announced a $14 million False Claims Act settlement with a local urology practice and its owner physician. According to the government’s press release, Advanced Urology, Inc. and its owner physician Jitesh Patel violated the FCA by billing federal healthcare programs for “a series of urological and diagnostic procedures that were not performed or were medically unnecessary.” 

The investigation was the result of two whistleblower complaints filed against the defendants under the FCA’s qui tam provisions. The first qui tam complaint was filed in 2018 and the second in 2019 by a fellow urologist. The qui tam complaints alleged that the defendants implanted certain nerve stimulator devices without first determining medical necessity, performed medically un necessary procedures which involved placing the patient under anesthesia and inserting a scope through the patient’s urethra and bladder; ordering “thousands” of unnecessary ultrasound tests; and, perhaps most disturbingly, “performing an electromyography test on almost every new patient [which] involved transmitting electrical signals through an electrode attached to the patient’s genitalia.” The whistleblowers will receive a combined total of just under $3 million as part of the settlement. 

As this settlement demonstrates, FCA investigations can take a long time—this one took nearly 8 years from the time of the first qui tam complaint being filed until settlement.
