Scott Grubman represents businesses and individuals in connection with a wide variety of matters, with a particular emphasis on defending clients in connection with government investigations, white collar prosecutions, and False Claims Act litigation. Scott has built a reputation for passionately, aggressively, and effectively representing his clients inside and outside of the courtroom, defending both their legal rights and their reputations.

While Scott’s clients span a wide variety of industries, the majority of his clients are healthcare providers facing investigations, audits, or litigation. Prior to joining private practice over a decade ago, Scott spent several years working for the United States Department of Justice, where he investigated and prosecuted healthcare fraud and other white collar matters on behalf of the United States. In that role, he worked closely with various law enforcement agencies including HHS-OIG. Since then, Scott has used his “insider’s knowledge” to ensure that his clients achieve the best result possible in every case.

In addition to his healthcare clients, Scott also regularly represents clients who are being investigated for, or who have been charged with, white collar crimes, including fraud, embezzlement, theft, and public corruption. He has first-chaired numerous criminal and civil jury trials in both federal and state courts and has handled both criminal and civil appeals. Scott is particularly skilled and experienced in handling high-profile matters, as many of his cases have garnered substantial attention by the international, national, and local news media, including some of the most highly publicized criminal matters in the history of the State of Georgia and, indeed, the United States. He has represented various public and elected officials including sitting judges, county Sheriffs, and high-ranking state officials.

In addition to his practice, Scott is a thought leader in the areas of white-collar crime and healthcare. He serves as an Adjunct Professor of Law at both Emory University and Georgia State University, where he teaches classes on white collar crime and healthcare fraud. He also speaks frequently at legal and industry conferences throughout the country and regularly publishes articles in nationally recognized journals and publications. He has served in leadership positions in various state and national legal organizations, including the American Health Law Association (AHLA), the Federal Bar Association, the American Bar Association, the State Bar of Georgia, and the Georgia Association of Criminal Defense Lawyers. He currently serves on the Executive Committee of the State Bar of Georgia’s Health Law Section and is a past chair for the Georgia Association of Healthcare Attorneys.

  • Represented home health care provider in connection with large Medicare overpayment matter. Successfully argued to ALJ that statistical sampling should be invalidated, turning a large, extrapolated overpayment into a small sample overpayment.
  • Represented physician as a plaintiff in a multi-million dollar defamation lawsuit against a national news organization. Secured highly favorable settlement and Court finding that statements were false as a matter of law.
  • Served as lead trial counsel in the only two False Claims Act (FCA) cases to go to trial in the state of Georgia.
  • Represented the alleged “architect of the fake elector plan” in connection with a RICO prosecution in Fulton County related to the 2020 presidential election.  Obtained highly favorable resolution, which entailed no jail time and first-offender probation.
  • Secured dismissal of murder indictment against client, a former Fulton County jailer.
  • Secured rare complete dismissal by court of multiple physician practices groups in connection with large FCA qui tam (whistleblower) action.
  • Represented pharmacy in DOJ criminal investigation.  Successfully negotiated closure of criminal file without charges, and resolution on a civil, overpayment-refund basis.
  • Represented physician after he received a “target letter” from DOJ.  Successfully negotiated closure of criminal investigation without any charges being filed.
  • Represented physician in FCA qui tam action involving alleged violations of the Stark Law and AKS.  After DOJ declined to intervene, whistleblower moved forward with litigation against all of the other (approximately 20) defendants, with Scott’s client being the only one who was completely dropped from the suit.
  • Represented healthcare provider in connection with a joint federal/state investigation involving alleged violations of the FCA, Stark law, and AKS, resulting from qui tam action. Negotiated a highly favorable resolution pursuant to which case was dismissed with prejudice without any monetary settlement or compliance agreement.
  • Represented large physician practice and affiliated surgery center in FCA qui tam action.  Secured a rare dismissal of the action by the DOJ.
